That is going to depend on a couple of things. First of all how severe is your knee pain? In the past, we have spoken with people about having some degree of pain, but it really comes and goes and it may be most apparent when they are trying to climb stairs and say that it can be painful but otherwise the pain is fairly minimal and comes and goes. In a situation like this, it is very unlikely that you are going to have a basis for a social security disability case.

Someone like this would be denied Social Security Disability Benefits because there are plenty of desk or sedentary jobs out there that would allow you to do the job without ever having to go up and down stairs. On the other hand at Sharon Christie Law we have represented people who have very severe knee pain and in fact, they may be waiting to get a knee replacement. In these situations, it may be something that actually is going to interfere with your ability to work and keep you from working for at least 12 consecutive months, which is basically the rule for Social Security Disability Benefits.

So knee pain in some instances can certainly be a basis for Social Security Disability Benefits for knee pain, but it all depends on what your medical evidence shows about the severity of your condition, how you have responded to treatment, and how your knee pain interferes with your activities day to day.
