Hi I’m sharon christie your nurse attorney for social security disability benefits. Let’s say you have gone through the process and you’ve talked to the judge, social security and the judge has issued a fully favorable decision that’s a great result. Now you have to wait to get paid and I’m always asked how long will this take?

 

If your case is social security disability it’s usually 30 to 60 days from the time the decision comes out. When the favorable decision is issued it’s sent to your lawyer. It’s almost always also sent to the payment center and the payment center then begins processing to see how much are you going to get every month, how much is your back payment, number of other things.
So usually within 30 to 60 days of the decision coming out you’ll see your first payment and or your back payment. One thing that can hold up the back payment it’s sort of a happy problem is if you get a very large back payment. That has to be signed off by multiple people. So we’ve had clients at times, this is not common but we’ve had clients at times who have had 50, 60, 70,000 dollar back payments and that’s taken longer because there are multiple people who have to sign off on the payment just to make sure it’s all accurate.
In the vast majority of cases you’re going to see your first monthly payment and your retroactive or back payment within 30 to 60 days if your case is ssi disability. Remember that’s the program that is asset based, it’s for people who don’t have enough work credits under social security. So if that’s your case there are some other steps that have to happen before you get paid the very first thing is you have to have a conversation with the local social security office to give them financial information. They’ll want to see bank statements. They ask for a number of financial documents if you have them. Life insurance policies are a good example. They’ll want to see that they’ll review that just to make sure you still qualify. On the asset side on the financial side to get ssi disability so we usually see that that’s going to take probably 60 to 90 days before payments get started. Make sure if your case is ssi disability that you do keep that appointment with social security. Which they can do it over the phone.
Keep that appointment with them to give them all the financial information that they’re asking for so that your payment can start being processed and there’s no delay. So that’s the general outline of how long it’s going to take to get paid. It’s a great day when you get a favorable decision, it does take a little longer to get payment but payment is coming, so just be patient.
